Waiver and Release

IMPORTANT: READ THIS DOCUMENT CAREFULLY BEFORE SIGNING. THIS IS A LEGALLY BINDING DOCUMENT. THIS FULLY SIGNED FORM MUST BE SUBMITTED BEFORE YOU CAN PARTICIPATE IN THE EVENT.

Camp Nageela Midwest, Inc. ("Nageela") a non-profit limited corporation with offices located in Chicago, Illinois, is producing its "Run for Red Leaf" event on September 18, 2022 (the "Event").  As consideration for, and as an express requirement of your participation in the Event, we require, and are materially relying on the requirement that you understand and agree to a waiver of any and all claims you might have against Nageela, its members, volunteers, officers, directors, employees, agents, independent contractors and other representatives as well as the Event  volunteers, guides, coordinators and sponsors (herein after referred to jointly and severally as "the Nageela Entities"), as well as agree to be bound by other terms and conditions stated in this Waiver.

As this is a binding legal document, you should read this document carefully before signing.  By signing this Waiver, and to the extent permitted by law, you waive any and all claims for damages for death, personal injury, loss or property damage which you may have or which may hereafter accrue to you against the Nageela Entities as a result of your or your participation in the Event and as related to the nature, type or condition of the events involved, and/or with respect to the condition of the sites involved, and/or with respect to the supervision provided, and/or with respect to the activities performed, whether or not caused by the negligence (active or passive) of the NageelaEntities, including any and all claims related to the COVID-19 epidemic. You acknowledge that the hazards and risks associated with the event include: 1) Risk of injury from the activity and weapons used in fishing and boating including the potential for permanent disability and death; 2)  Possible equipment failure and/or malfunction of equipment which may have been rented, borrowed, or personally owned; 3) Hazards related to fishing and boating from a vessel which include collision, capsizing, sinking, or other  hazards that may result in wetness, injury, exposure to elements, hypothermia,  impact of the body upon the water, marine life forms, and/or drowning;  5)weather related injuries and illness including but not limited to heat exhaustion, heat stroke, sunburn, hypothermia and  dehydration; 6) Exposure to outdoor elements, including but not limited to inclement weather, thunder and lighting, severe and /or varied wind,  temperature as well as all other weather conditions; 7) Attack by or encounter with insects, reptiles, and/or animal; 8) Accidents or illness occurring in remote places where there are no available  medical facilities;  9) Fatigue, chill, and/or dizziness, which may diminish my/our reaction time and  increase the risk of accident; and 10)exposure to COVID-19 or other diseases, which could result in permanent injury or death.

You also agree to indemnify, defend, and hold the Nageela Entities free and harmless from any and all expenses, demands, claims, costs, losses, damages, recoveries, settlements, and expenses (including but not limited to interest, penalties, attorney's fees, expert witness fees, costs, and other expenses) of any nature or kind which are incurred, known or unknown, contingent or otherwise, directly or indirectly arising from or related to your participation in the event.  No refund or adjustment is made, and no prior notice is made, if the Nageela Entities change the Event by adding, altering, or deleting activities as the Nageela Entities deem necessary. It is also understood and agreed that the Nageela Entities have made no promise or pledge, express or implied, to provide any special facilities or services to those with any medical problems, health problems, or physical disabilities, including but not limited to accommodation of any COVID-19 related sensitivities. The Nageela Entities reserve the right to dismiss or remove you for misbehavior at any time. You acknowledge that if you are dismissed or otherwise removed from the Event and there shall be no refunds given. You agree that the Nageela Entities may use any pictures, videos, or sound recordings taken of you during the Event. This agreement shall represent the full and complete agreement between the parties, and any modification of the terms set forth herein shall be effective only if in writing and signed by all parties hereto. The parties to this agreement stipulate that this agreement shall be considered to have been entered into in Chicago, Illinois, and that any interpretation of the terms of this agreement shall be made under Illinois law, without respect to its conflict of laws provisions. I certify that I have read this document and that I understand and agree to all of the foregoing information, terms, and conditions.
